What happened
An Instagram advertisement for NICONI Tan Vanish showed a voiceover and before-and-after visuals: "After applying this and wiping it off after 20 minutes, I was so shocked, look at that colour difference!" The visuals showed tanned skin transforming to a brighter complexion within that 20-minute window.
ASCI's monitoring flagged the ad and asked the advertiser to substantiate the claim. Formulate Brand submitted no written response or supporting documents by the due date.
With no substantiation, the Consumer Complaints Council considered the complaint exparte. The 20-minute tan-removal claim had no clinical evidence or third-party test report behind it, and the before-and-after visuals showed no proof of the transformation.
The Council upheld the complaint: the claim was misleading by exaggeration and likely to cause widespread disappointment, contravening Chapter I clauses 1.1, 1.4 and 1.5 of the ASCI Code. The representation had to be modified or withdrawn.
Why it happened
- 'Look at that colour difference' sold a transformation the brand produced no evidence ever happened — and then let the deadline pass without responding
- A 20-minute tan vanish is a dramatic claim: it needs before-and-after imagery that is real, and clinical proof that the product can do it
- ASCI's own monitoring caught it, and the advertiser's silence handed the Council an exparte ruling
The lesson
A dramatic before-and-after needs the after to be real. No clinical test, no response to the regulator — and the '20 minutes' claim collapses into an exparte upheld.
Aftermath
ASCI recommended the misleading representation be modified or withdrawn. The case was decided exparte because the advertiser did not respond by the due date, turning what might have been a defence into a default loss — a reminder that silence before a self-regulator is treated as an admission.
