What happened
Washington Insurance Commissioner Patty Kuderer's office fined Express Scripts, Inc. $35,000 for regulatory disclosure failures, according to the October 6, 2026 enforcement summary covering April–August 2026. Express Scripts, a Wilmington, Delaware-based healthcare benefit manager, did not report seven previous administrative and disciplinary actions from multiple state regulators in its initial application for registration in Washington, and did not report a complete accounting of its administrative and disciplinary actions in subsequent annual filings.
The concealment was not a single omission. The company also failed to report material changes to the Office of the Insurance Commissioner within the required timeframe and provided incorrect, incomplete, or false information to the regulator. The fine was the largest in the announcement after the two claim-handling fines against USAA Casualty Insurance Co. and Allstate Vehicle and Property Insurance Co.; the same round levied $215,000 against 19 companies and $20,250 against nine agencies and producers, for a total of $495,200.
What it cost
$35,000 fine (Washington OIC order 26-0034), part of $495,200 in fines the office issued between April and August 2026.
Why it happened
Seven disciplinary actions from other states were left out of the initial registration application — the one document designed to surface them.
Annual filings are a continuing duty, and the company still did not give a complete accounting of its disciplinary history in them.
It missed the required window for reporting material changes and gave the regulator information that was incorrect, incomplete, or false.
The lesson
Registration forms exist to surface the history a company would rather not volunteer: omit past disciplinary actions once and the duty to keep filings accurate follows you into every annual report.
Aftermath
The fine was announced on October 6, 2026 as part of Commissioner Kuderer's April–August 2026 enforcement summary. No further orders against Express Scripts were listed in the announcement; the disclosure failures were fined as administrative violations rather than escalated.
