BetNacional sold betting as the way up — Procon-SP called it misleading

July 2025: Procon-SP fined BetNacional's operator R$601K — ads starring Vini Jr. and Galvão Bueno pitched betting as a solution to life's problems.

What happened

BetNacional's advertising, operated by NSX Brasil, presented online betting as socially attractive — a solution for social, professional and personal problems — endorsed by sports personalities and celebrities including Galvão Bueno, Vini Jr., Ludmilla and Olympic champions. Procon-SP found the advertising misleading: it associated a product whose expected outcome is losing money with upward mobility and problem-solving.

On 11 July 2025 Procon-SP fined NSX Brasil R$601,504, also citing abusive clauses in the terms of use — language attempting to exempt the company from liability and a failure to clarify winning limits. The case landed inside Brazil's wider crackdown on 'bets' advertising as household gambling losses mounted.

The principle is the one consumer codes apply to every category, turned on the newest one: advertising may not present a loss-expectation product as a path to solving life problems. Celebrity endorsement does not soften the claim — it carries it, and the fine names the ecosystem that ran it.

Why it happened

  • The ads pitched betting as a solution to social, professional and personal problems — the opposite of its expected outcome.
  • Sports stars and celebrities carried the claim, lending it the credibility of success stories.
  • The terms of use tried to exempt the company from liability and obscured winning limits.

The lesson

A product whose expected outcome is losing cannot be advertised as a solution to life's problems: the promise is measured against the odds, and endorsement carries the claim rather than shielding it.

Aftermath

The fine was part of Procon-SP's enforcement wave against betting operators as Brazil regulated the sector. NSX Brasil's case is cited in Brazilian consumer law for the limits on gambling advertising.
