Spain's competition regulator CNMC sanctioned Veo Televisión, Gol TV's owner, for two continuing serious infringements: broadcasting gambling-related adverts outside the 01:00–05:00 window, and airing sponsorships that directly encouraged viewers to buy. Gol TV had aired three adverts for BW Scores, a scores app, twice on 1 July 2024 and once on 3 July 2024, just before 01:00, around live martial arts programming. The voiceover sold results and statistics, but the on-screen interface carried a button labelled '1 X 2 Apuestas'. The two late-night programmes drew 37,140 and 45,060 viewers.

Veo TV argued that BW Scores is an information service that takes no bets or funds, that the button appeared for about one second, and that the self-regulator Autocontrol had cleared the creative on 29 April 2024. The CNMC rejected all of it: it is irrelevant whether the advertiser is a gambling operator or whether the advertised service allows betting — what matters is whether the communication is objectively related to betting. Autocontrol's report had not mentioned the buttons and was conditional on BW Scores advertising not being perceived as indirect advertising for Betway.

The regulator set €48,237 for the betting adverts — citing the small number of insertions, the limited audience and Veo TV's good faith in seeking Autocontrol's view — and €87,318 for two Finetwork and six Banco Santander sponsorship insertions that pushed specific offers and promotional prices. Veo TV paid on 1 September without admitting the facts, taking the total from €135,555 to €108,444; the discount required waiving an administrative appeal, though the company can still go to the Audiencia Nacional within two months.

The consequential line is that the statutory window applies to any advert 'related to' gambling, whoever the advertiser and whatever the product — telling broadcasters that sports data apps, tipster brands and other indirect vehicles carrying betting cues will likely be treated the same way, and that pre-clearance is mitigation, not a defence.

€135,555 in fines cut to €108,444 with early payment (paid without admitting the facts); the betting portion is about €38,600 against €16.5M annual ad revenue.

The creative's '1 X 2 Apuestas' button objectively tied the ad to betting, so the app's no-bets design and the button's one-second display cut no ice with the regulator.

Veo TV leaned on an Autocontrol pre-clearance that never mentioned the buttons and was conditional on avoiding indirect Betway perception — clearance is not a licence.

Sponsorship insertions for Finetwork and Banco Santander named specific offers and promotional prices, crossing from sponsorship into direct encouragement to buy.

A regulator reads what viewers see, not what your compliance file says: one betting button on screen can reclassify an innocent app ad as gambling advertising.

Proceedings opened in September 2025 and the resolution landed 26 months after the broadcasts, close enough to the LGCA's two-year limitation period that Veo TV argued the Santander insertions were time-barred — the CNMC rejected that. The Supreme Court had annulled parts of Royal Decree 958/2020 in April 2024, but the broadcast hours survived because Parliament wrote them into Law 13/2022, and Spain's gambling regulator DGOJ is consulting on statutory bans on celebrities and influencers. Spain's online gambling revenue rose 31% to €539M in Q2 2026.
