Tío Nacho's benefits never had proof — PROFECO fined Genomma MXN 2M

What happened

Tío Nacho Matizante, the shampoo from Genomma Lab, was advertised with benefits the product could not deliver. PROFECO, Mexico's consumer prosecutor, asked the company for the evidence behind the advertising phrases — the substantiation of the promised performance. Genomma Lab did not produce it.

On 16 July 2013 PROFECO fined the company 2,033,000 pesos for misleading advertising. It was one of the early enforcement actions against the direct-response advertising model Genomma Lab built its catalog on: heavy claims, heavy media spend, light documentation.

The mechanics are the whole lesson: when an advertiser cannot show the evidence for its claims on request, the regulator does not need to prove the claims false — the silence is the violation. The claim carries the burden of proof.
