In October 2021, Mausam Meena ordered a Realme Narzo 50A through the Flipkart app for Rs 10,574. The parcel delivered the next day was sealed but held bars of soap. Flipkart told him on 17 November 2021 his return could not be processed because images of the product had not been shared — he had sent screenshots and an email with his Aadhaar attached, and kept pushing.

Flipkart Internet argued it was only an intermediary under Section 79 of the IT Act and that the seller, Luminary Lifestyle Pvt Ltd, should refund; logistics arm Instakart said it had delivered the seller's sealed box. A video of the unboxing, placed on record in a 31 July 2026 order, showed the soap.

The Consumer Disputes Redressal Commission-X rejected the intermediary shield: a facilitator owes customers support services — logistics, payments, complaint resolution — and buyers trust the platform even when a third party lists the product, citing NCDRC's Rediff.com vs Urmil Munjal (2013). On 18 September 2026 it found Flipkart guilty of deficiency in service and unfair trade practice, ordering Rs 10,574 back with 7% annual interest, Rs 5,000 for mental harassment and Rs 5,000 in litigation costs, with 60 days to comply.

Refund of Rs 10,574 with 7% annual interest plus Rs 5,000 harassment and Rs 5,000 litigation costs

The sealed-box substitution happened inside Flipkart's own fulfilment chain, not at a store counter

Flipkart's first response was to bounce the return for missing images the customer had already sent

The marketplace argued seller responsibility while billing on its brand and controlling the purchase funnel

Five years of escalation suggests no effective complaint path for a fulfilled-order substitution

A marketplace cannot hide behind 'the seller did it' — customers bought from your app, trust your brand, and the law holds the storefront responsible.

The 18 September 2026 order gave Flipkart 60 days to pay. The ruling leans on NCDRC precedent that platform facilitators carry inherent responsibility for support and redress — a reading other Indian marketplaces will have to answer to.
