Durex turned '419' into a cross-brand pun night — regulators fined it for the punchline

Durex traded innuendo with Heytea, Ele.me and Taopiaopiao under '419 Sleepless Night.' State media called it soft porn; regulators fined it ¥800,000.

What happened

On 19 April 2019, Durex's official Weibo account launched a cross-brand campaign under the hashtag '#419不眠夜#' — '419' read aloud in Mandarin puns on the English 'for one night.' Durex traded suggestive copy with half a dozen brands that replied in kind: Heytea answered Durex's 'not a drop left tonight' line with 'your lips will always carry my cheese'; Ele.me posted 'feed every mouth tonight'; Taopiaopiao suggested crawling into a dark corner of the cinema.

The exchange went viral within hours for the wrong reason. Commenters called the wordplay a coordinated string of sexual innuendo dressed up as playful cross-promotion, and criticized Heytea and the other brands for playing along with a condom brand's tone rather than setting their own. Heytea deleted its post and apologized the next day, saying it had 'no ill intent' but would be more careful with tone going forward; other participating brands quietly edited or removed their posts.

The scrutiny didn't stop at brand Weibo accounts. On 23 April, the national Office Against Pornographic and Illegal Publications reposted a commentary describing the campaign as 'soft porn' and folded it into an ongoing crackdown on low-taste online content. In December 2019, Shanghai's market regulator fined Stance Innovation Trading (Shanghai), the company behind Durex's official account, ¥800,000 for the campaign under the Advertising Law's ban on content that offends public order or good social custom.

Why it happened

  • Durex built the campaign on a pun that only works as innuendo — the tone was baked into the concept before any partner brand signed on.
  • Partner brands accepted Durex's tone instead of translating the collab into their own voice, so their own audiences read the innuendo as coming from them, not just from Durex.
  • Nobody weighed that a condom brand's edgy tone reads differently once amplified across food and entertainment brands with broader, more mixed audiences.

The lesson

Borrowing a partner's edgy tone for a co-marketing stunt means inheriting their controversy too — and the fine, when it comes, lands on the brand that set the tone, months after the trend has died.

Aftermath

Heytea and the other partner brands deleted or edited their posts within a day. The Office Against Pornographic and Illegal Publications' rebuke folded the campaign into a broader 2019 crackdown on 'soft porn' marketing. Shanghai's market regulator fined Durex's account operator ¥800,000 in December 2019 for violating the Advertising Law.
