Saga Falabella's mattress ad linked a Black character to mess — Peru fined it S/84,000

A Drimer mattress ad showed a light-skinned roommate as tidy, her Afro-Peruvian roommate as messy. Indecopi fined the retailer and its agency for it.

怎么回事

In September 2018, Peruvian department store Saga Falabella posted a Facebook video for its Drimer mattress line showing two young women as roommates. The light-skinned roommate was portrayed as clean and organized; her Afro-Peruvian roommate was portrayed as messy and prone to disorderly habits, played for comic contrast between the two.

Peru's Ethnic Development Center (CEDET) and the Ministry of Culture's 'Alerta Contra el Racismo' platform condemned the spot, saying it associated Afro-descendant identity with a lack of hygiene and order. Saga Falabella removed the video from its channels within about two hours of the backlash starting and issued a public apology.

Indecopi's Commission for the Repression of Unfair Competition subsequently fined Saga Falabella and its agency, Circus Grey, a combined S/84,000 (roughly $25,000 at the time) for running advertising that induced racial discrimination — one of the regulator's clearest applications of Peru's advertising rules to a discriminatory stereotype rather than a false product claim.

教训

A good/bad contrast in an ad is only safe if the two sides aren't mapped onto two ethnicities. If a stereotype makes the joke work, the joke is the stereotype — pulling it fast doesn't undo the fine.

后来呢

The case became a reference point in Peruvian advertising-law commentary for extending Indecopi's unfair-competition powers to discriminatory content, not just deceptive claims, and pushed local agencies toward pre-publication diversity review of casting and character framing.
