For more than a decade Intuit ran 'free, free, free TurboTax' advertising while quietly steering eligible low-income and military taxpayers toward paid products. From 2007 to 2021 the company offered two competing 'free' tiers: the genuinely free IRS Free File program for taxpayers earning $36,000 or less, and its commercial 'Free Edition,' free only for 'simple returns.' Eligible taxpayers were never told they qualified for the truly free IRS product — they were told they had to upgrade for fees 'starting at $59.99' and sometimes 'over $200' to file accurately.

The 'Products and Pricing' page did not list the IRS Free File product at all; the only route to it was a convoluted and unintuitive path. Although roughly 70% of taxpayers qualify for IRS Free File, fewer than 3% used it in 2020. A coalition of 51 state attorneys general, the Los Angeles city attorney and Santa Clara County pressed the case as deceptive advertising built on dark patterns.

In May 2022 Intuit agreed to a $141 million nationwide settlement — $11.4 million going directly to roughly 370,000 Californians. The company admitted no wrongdoing but was barred from lying about an advertised free product, required to clearly disclose the free product's limits, and barred from forcing users to re-enter data when returning from a paid tier to the free product.
