Win promised Peru's fastest internet 'never drops' — Claro complained, Indecopi agreed
Dec 2025: Indecopi fined Win (WI-Net Telecom) S/474,812 — 42 ads claimed the fastest plan and zero delays, with no evidence. Claro filed the complaint.

Win, the Peruvian fixed-internet brand of WI-Net Telecom S.A.C., ran 42 advertising pieces promising superlatives: 'Con el plan más veloz, navega al toque y sin complicaciones', 'Con WIN no tendrás retrasos en tu señal' — the fastest plan, no delays, the best connection that never drops. The complaint, notably, came from a competitor: América Móvil Perú, operator of Claro.
Indecopi's unfair-competition commission found the messages misleading: they presented benefits that were not substantiated or did not correspond to the actual characteristics of the service, generating error in consumers and distorting competition. In Resolution 233-2025/CCD-INDECOPI, dated 15 December 2025, Win was fined a total of 88.75 UIT — S/ 474,812.50 — differentiated per ad, with the highest-reach pieces sanctioned above 10 UIT each.
The ruling was first instance and open to appeal, and it ordered the immediate and definitive cessation of all 42 ads, citing the risk that they would be re-diffused. For telecom advertising in Peru it confirmed the pattern of the region's regulators: 'fastest' and 'never drops' are measured claims, and the burden of proof sits with the brand that airs them.
