Stark Smart Gym S.A.S., a Colombian gym chain, advertised a 'Plan semestre $499.000' promotion. The SIC found the offer omitted essential information for the decision: the start date of the promotion and the number of units available. Consumers could not tell when the price applied or whether it was still on offer.
The regulator also flagged the contract language around refunds, the consequences of terminating a plan, and the conditions for suspending or freezing membership — clauses it said created 'an unjustified imbalance to the detriment of users.'
On 9 April 2026 the SIC imposed a fine of 285,166,280 Colombian pesos on Stark Smart Gym. The sanction was part of a broader gym-sector sweep: combined fines against Bodytech, Sporty City / Smart Fit Colombia, Health and Life, and Powerclub totalled 915,241,856 pesos, with appeals still pending.
